USED APPLIANCE WARRANTY FOR PURCHASES
Limited Warranty-
There is no implied warranty of merchantability nor any implied warranty of fitness for a particular purpose. There are no warranties either express or implied which extend beyond those set forth herein. Each appliance is sold AS IS and carries a limited warranty commencing from the date of the purchase invoice. Berry’s Appliances (BA) shall repair the appliance, if deemed viable, (at the discretion of BA) or will offer an exchange of the same value within sixty (60) days of the invoice date if the appliance fails mechanically. Customer must provide proof of purchase for warranty to be valid. Commercial use, multi-family housing or other than normal use of the appliance will void the warranty. Functions of the appliances that are warrantied are as follows: washers should with water, agitate, spin, and drain; dryers should tumble and heat, and door switch and timer should work properly; stove clocks turn on, burners and bake/broiler elements heat; refrigerators will turn on, cool/freeze water for 24 hours.
If customer requests warranty service and the problem is caused by the customer (such as a clogged drain, improperly installed water hoses, unlevel appliance, blown circuit breaker, improper cord installation, faulty power source that causes electrical parts to burn out, etc.), then customer will be responsible for the cost of the service call. Customer will only receive one exchanged item for this warranty if deemed that the purchased and covered item is not working properly. The replacement item will carry the same limited warranty as the one replaced. There are no refunds. Items such as self-cleaning mode, leveling legs, broken shelves, cosmetic items, icemakers, water dispensers, fill hoses, and any item resulting from customer's misuse are not covered under this warranty. Appliances bought at BA location and then taken outside of BA service area limited to Ft Worth and Crowley will need to be brought in store to honor warranty.
If you take your appliance home in your own vehicle, you understand that only major mechanical errors to parts such as motors, belts, timers, compressors, fans, water pumps, heating elements, and lid and door switches are covered under this warranty. If you damage the item during transit or installation, it is not the responsibility of BA to repair or replace the item. If you lay the appliance down or cosmetically damage the appliance it is not covered under this warranty. Please discuss proper handling with an associate. If you damage the item during transit or installation, it is not the responsibility of BA to repair or replace the product.
Should BA need to make repairs to an appliance covered under this warranty, a service call will be scheduled within three (3) business days of reported mechanical failure and said repairs shall be completed within seven (7) business days from the time all parts are received by BA. If the appliance is leaking water or not cooling at the appropriate temperature, it is the customers duty to mitigate damage and expenses. BA will attempt to expediate a service call for issues involving water leaking or refrigerators not cooling at the correct temperature. If a third party other than that ordered by or employed by BA works on your appliance, the warranty from BA is null and void and BA is not responsible for charges related to repairs performed by another company. This warranty is extended to the original purchaser as set forth in the invoice and is not transferable to subsequent purchasers of the appliance.
Exchange due to size- If you bring your appliance home and determine that it does not fit into or you cannot get it to the appropriate place (i.e. your hallway is too narrow for the refrigerator you just bought), BA will offer a 48-hour exchange on that item from the date of invoice. You must bring the item back to BA in good working condition for this offer to be valid. If the item that does not fit into the appropriate place was delivered by BA, there will be no refunds delivery charge. If customer requests that BA pick up and bring back the appliance, charges may apply for the service.
Limit of Liability –
BA shall not be responsible for any damage caused by appliance failure including, but not limited to, fire, flooding, personal injury, death, damage to personal or real property such as spoiled food, or any other liability whatsoever. The following is specially excluded from warranty coverage: misuse, abuse, improper transportation, installation or operation of the appliance, the modification of the appliance, or damage to the appliance due to the negligence of the customer.
Trade-Ins/Haul away items - If you have a trade-in or requested that BA removes your old appliance, you understand that BA will attempt to repair and resell your appliance. You waive ownership of this appliance as soon as BA removes it from its original location.
Delivery- Delivery fee is for one trip only. If you are not home at the time of delivery, BA does not install any appliances and will not enter your household for any reason, including the removal of your old appliance. Your purchase will be placed on the front porch, driveway, or garage as requested by you. BA will only take away your old appliance if it is sitting outside your home in an easily accessible area. BA takes no responsibility for damage to items that are taken home by customer, left at the home while customer is not there, damage caused by improper installation, weather conditions, theft, improper transit or for any damage due to the delivery of your appliance(s). BA charges a delivery fee for every trip. If the customer is not at home for delivery, BA delivery driver will wait no more than 15 minutes for customer arrival after that, it is the customers responsibility to pay for additional delivery. We are not held responsible for moving any furniture or valuables. If you wish to cancel your delivery, you must inform BA no later than 24 hours prior to the scheduled time so we can make the needed arrangments. Delivery charges are not refundable once the delivery has been attempted or completed, regardless if there is a return or exchange of that appliance.
Safety- To promise good health and safety of any BA employee, BA reserves the right to refuse or reschedule work due to unsafe conditions, which include, without limitation, extreme temperatures, natural disasters or the existence of other hazards, real or perceived.
Cords and additional accessories - BA will make sure your appliance has the proper cord for no additional fee. It is your responsibility to notify BA of any cord change at least 3 hours before your delivery time. If BA delivers your appliance and the cord type is incorrect, it is your responsibility to purchase the correct cord and install it at your expense. Dryer vents, refrigerator water lines, gas hoses are not supplied unless otherwise stated in sale. Consumable parts such as water filters, lightbulbs, etc. are excluded from this warranty.
Important- BA will not under any circumstances be responsible for any damage claims to merchandise, personal property, valuables or floors made after the appliance has been delivered. This limited warranty is only given to the customer hereunder and we will not be liable to third parties, nor should BA be liable for indirect or consequential damages, except for the limited warranty set forth above. There are no other warranties or guarantees, expressed or implied, and we specifically make no warranty with respect to merchantability or fitness for a particular purpose. We do not make any guarantee with respect to any other parts.

WARRANTY FOR SERVICE CALLS
Service Limited Warranty-
Types of Services We Offer:
Appliance Repair – Refrigerators – Freezers – Clothes Washers- Dryers – Front Load Clothes Washers – Dishwashers - Stoves / Ovens / Ranges / Cooktops – Ice Makers
Service Calls-
This includes a trip to customers home to diagnose the problem. We will provide customer with an estimate of the repair cost which includes parts and labor. In some cases, computer diagnosing or intense disassembly may be subject to additional labor costs. Customer will authorize the repair before any work is done or parts ordered. Depending on diagnosis, brand of appliance or severity of the issue, parts may need to be ordered. In that case BA will schedule a secondary appointment with you to complete repairs within two (2) business days after parts are received or purchased. ANY WORK performed on the appliance owned by the customer or another company will void all warranties.
Store Drop Off Service- Drop offs entail a customer “dropping off” an appliance for repairs at a BA location. This includes a diagnosis of the problem. Drop offs are inspected on a first come first serve basis and are secondary to service calls. BA will diagnose the appliance within forty-eight (48) hours after drop off. Once diagnosed, BA will provide you with an estimate of the repair cost including parts and labor. You will authorize the repair before any work is done or parts ordered. Once authorized, repairs will begin within two (2) business days after parts (if any) are received or purchased. Upon drop off, you authorize BA to dismantle appliance as needed for repairs. Once repairs are completed, BA will contact you and it is your duty to pick up the appliance no later than three (3) business days.
If you are given a diagnosis and wish to not continue with repairs, it is your duty to pick up the appliance no later than three (3) business days from when the diagnosis was given or you may authorize BA to dispose of the appliance.
BA will make reasonable attempts to contact you but if three (3) business days pass and the appliance(s) has not been picked up by you, storage charges of $10 per day will be incurred. Storage charges will continue to be added daily until the appliance(s) is picked up but will not exceed the maximum of thirty (30) days. The charges will be added to your overall balance and you will be responsible for them.
Abandoned Appliances- Whether you repaired the appliance or not, if the appliance has not been picked up after thirty (30) days from the day a diagnosis was given or repairs completed, you waive ownership of this appliance and of any property left inside, and you understand that BA will attempt to either dispose or repair and resell your appliance.
Limited Warranty- If BA repairs an appliance and it breaks down again during our thirty (30) day warranty period, BA will schedule a secondary appointment with the customer and determine the cause of the problem. If the breakdown has anything to do with the original repair, we will repair it at no expense to the customer. If the machine has another problem not related to the first issue, we will treat the repair as if we had diagnosed both problems at the same time and price for labor and parts separately. The customer does not pay an additional service fee as it will be treated like we made the complete diagnosis on the first trip to your house. If your machine is not worth spending any additional money on, we will remove any parts (that are able to be salvaged and returned in working condition) we previously installed and give you back the original charges less the service call charge. Limited warranty under the manufacturer means all parts sold then installed by BA will perform satisfactorily under the conditions of normal use.
This limited warranty is only given to the customer hereunder and we will not be liable to third parties, nor should BA be liable for indirect or consequential damages, except for the limited warranty set forth above. There are no other warranties or guarantees, expressed or implied, and we specifically make no warranty with respect to merchantability or fitness for a particular purpose. We do not make any guarantee with respect to any other parts. This warranty applies to labor provided during normal working hours only. Additional charges will apply for other than normal working hours. We assume no liability nor make any guarantee for any loss, including food, valuables, or property caused by a failed part.
Additional- Customer satisfaction is highly important to BA, we offer service call customers that find their appliance is a total loss (not worth repairing) to apply their previously paid service fee towards a new or used appliance available for sale at any BA location. Excludes and cannot be used in conjunction with any promotion, discount, or coupon.

BA reserves the right to refuse installation of any appliances due to code infractions. It is the sole responsibility of the home owner to maintain the appliances as recommended by manufacturer and is responsible for all consumable parts such as filters, ducts, lint traps, lightbulbs, etc. If any appliance may require being moved from its current position for repair or removal, BA shall take proper precautions to not cause damages to the surrounding areas however shall not be held responsible for any damage that may incur.
